Overtime Laws
Back to Practice Areas
In New York, as in other parts of the United States, qualified employees who work more than 40 hours a week are entitled to overtime pay, which must be at least one and a half times the standard wage rate.
This requirement is a federal law under the Fair Labor Standards Act (FLSA), but New York State has additional overtime requirements stipulated in the New York State Minimum Wage Order. When there is a conflict between state and federal laws, employers must comply with the direction that best suits their employees' interests.
If your entitlements are not paid overtime, I suggest you talk to an overtime lawyer in New York City today.
Although overtime pay is a welcome incentive for many New York City workers, there may be some restrictions on overtime pay. State labor laws require workers in certain occupations, including restaurant and factory workers, to rest for at least 24 consecutive hours in 7 days.

What is the New York law on overtime pay?

If you run a business in New York City or work for a New York City employer, it is essential to have a thorough understanding of New York's overtime laws. Several factors determine whether an employer should pay overtime and to whom. The way employees are paid one of these factors. Although many salaried employees can be exempted from overtime pay, this exemption does not apply to all employees with a fixed salary. Most employees are eligible for overtime pay under certain circumstances.
Although eligible employees are automatically paid overtime for working more than 40 hours a week, they are not paid on working nights, weekends, or holidays. The extra pay for working these hours is usually based on company policy, not the law.
In addition, although specific jobs are not subject to FLSA's overtime requirements, New York State law may still require these employers and contractors to compensate workers for overtime.
If you are unsure how overtime laws apply to you, please immediately consult an overtime lawyer in New York City. This is in your best interest.
